1. These terms and conditions explain our services to You as our client and your obligations to Us, Pi Expert (a trading division of PiExpert Limited). They take precedence over any other documents, conversations or course of dealings and represent the understanding between You and Us. Ordinarily any variation must be with our written agreement signed by a director. You must read these terms carefully since they apply as soon as we send them or make them available to you on our website. We accept no responsibility for You failing to read them.
2. We provide a variety of services by phone, internet, mail and other means. These may include acting as a loan and finance broker; introducer to debt and property possession adjusters/advisers, utility switching agents, compensation advisers, prepayment card and bank account providers, pay day loan lenders, debt management companies, insolvency practitioners, bankruptcy specialists, equity release arrangers and credit reference advisers. You must rely on your own expert advisers for tax or legal advice regarding the services we offer; we are not responsible for those fields. You authorise Us and any associate companies to act on Your behalf by asking Us to provide You with services.
3. When You ask Us, orally or in writing, to provide You with a service, You agree to abide by these terms. We acknowledge your instructions either expressly or by acting upon them. You can only withdraw or vary your instructions with our consent. We treat You as our Client. We accept no liability or obligation to any third party whether or not You may be acting as their agent, fiduciary or intermediary. Your obligations to Us remain unaffected even if You disclose their identity to Us and You are acting in such a capacity. We are entitled to act on any written or oral instructions We receive from You or anyone We believe is authorised by You to give them.
4. Our services are subject to restrictions laid down by law and regulations or imposed by market conditions. You authorise Us to do anything We consider appropriate or necessary to provide the services and comply with applicable laws and regulations. Everything We do lawfully in exercising such discretion You agree to ratify. We have no obligation to do anything we believe would breach such restrictions. We have an absolute discretion to refuse to accept instructions without having to give reasons for doing so. We shall take reasonable steps to let You know promptly if we decline to act.
5. When acting as a loan or finance broker we seek to get a lender or financier to offer You a loan or finance solution that is suited to your needs in our opinion. This solution can include a debt management plan or an IVA to help you reduce your monthly credit repayments to an affordable level. In order to maximise your chances of getting a lender or financier to make You a loan offer or a company to offer you a appropriate finance related solution We act as your broker. We seek to match one or more of the lenders or financiers we deal with with your loan or finance application. We do not act on behalf of the lenders or financiers or represent them. We require the documentation covering any loan or finance agreement to meet statutory and regulatory safeguards laid down by the Consumer Credit Acts 1974 and 2006 for your protection. The Act provides you with the right to settle the agreement at any time by giving notice in writing and paying off all amounts under the Agreement (which may be reduced by the rebate) as described under the relevant section of this agreement. Please contact your local Trading Standards Department or The Citizens Advice Bureau if You would like to know more about the protections and remedies provided under those Acts.
6. We do not give or guarantee loans or finance. Pi Expert is an independent finance broker and not a lender. The lenders or financiers decide whether to approve loan or finance applications, how much to lend or finance, on which terms, on what evidence of ability to repay and at what interest rate. Where We give examples they are only illustrations. We do not warrant that examples are the actual rates and amounts because the lenders or financiers, according to your specific circumstances, decide whether to give approval for any loan or finance and on what terms and what APR. You understand we cannot be held liable in any way for a lenders refusal or the non provision of a loan or finance however, based on the information provided by you Pi Expert feel that we should be in a position to secure a loan or finance for you. This agreement does not however guarantee the provision of a loan as the lender grants the final approval.
7. You agree to Us using telephone, email, SMS, fax and/or post to contact You to discuss products and services without having first been expressly invited to do so, unless You inform Us differently. Any registrations You may have with any preference services will be overridden. To communicate in writing We may use the last postal address You give Us. Please note that we can and may monitor and record any telephone conversations with You for security, training and evidential purposes to improve our service.
8. In trying to get You a loan or finance, make decisions about You, manage your accounts, utilities, premiums, debts or provide any other services, We or associate companies (including lenders and financiers) may use credit scoring or other automated systems to assess your application, make decisions and verify your identity. These systems include searching your records with employers, credit reference agencies, fraud and money laundering prevention agencies and the electoral register as well as providing them with information. These agencies can add your details to their records for other organisations to do searches. Where there are joint clients, both records are processed by the agencies and a link between You can be created. You both understand that each others’ information will be taken into account in all future applications by either or both of You, and this linking will continue until one of you successfully files a “disassociation” at the credit reference agencies.
9. To help our fraud prevention and data protection strategy, You agree to the processing and using of personal data (whether provided electronically, in writing or orally) You give Us and our associate companies, credit reference agencies and selected third parties. Unless You notify Us to the contrary You agree to Us using the data to advise You of other products and services. The information You give Us must be true and accurate. So that We can comply with our obligations You warrant and undertake to comply with legal and regulatory disclosure requirements. We may notify agencies which would have a detrimental impact on your credit records if You provide Us with false or inaccurate information and/or We suspect fraud. We reserve the right to reclaim any losses incurred by Us in performing the service to You in the event that You provide Us with inaccurate or misleading information.
10. Any action We take on a third party’s instructions will be binding on You if You authorise anyone else to give Us instructions. If there are joint applicants each has authority to deal with Us for the other. Notice to one is notice to both. We can require joint instructions. We can choose to take no action until We receive satisfactory instructions if instructions from different joint applicants are inconsistent. You must notify Us in writing to withdraw any authority.
11. We charge an administration fee for providing our services. We specify the fee as part of our communications with You. Once we have processed your details and sent them over to our lenders, a refund will not be payable. Unless you have cancelled the application before we have charged the administration fee. To facilitate Us processing payments and post dated payments You authorise Us to retain your charge, credit or debit card details.
12. If We provide services other than acting as a loan or finance broker, We may be entitled to a fee for those services. If We introduce You to a lender or financier that makes You a loan or finance offer, We may also receive a variable commission from the lender or financier (more detail is available on request) in addition to the fee you pay us and You agree that We may retain it. If after we enter into this agreement You commission us to perform another service for You then You agree that a new fee may be payable and any fee You paid to Us may be transferred over by Us to cover our charges for this separate service.
13. Under Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel your application within 14 days of receiving these terms and conditions and receive a refund. If You wish to cancel Your application, You must write to PiExpert notifying Us. In this event We will refund Your fee within 14 days of the date on which You write to Us to cancel your application. Any such requests should be made to: Pi Expert, Unit 207, 40 Princess Street, Manchester, M1 6DE. Interest at the rate shown will accrue on a daily basis on the Total amount Repayable. If any payment is not met when due then the outstanding interest itself bear interest at the annual percentage rate shown overleaf.
14. If you wish to repay the Total Amount Repayable early you may do so paying:
1. All arrears of monthly payments and interest thereon plus
2. All future monthly payments which would have fallen due if this agreement had continued without early payments less a rebate on these monthly repayments in accordance with the Consumer Credit (rebate on early settlement) Regulations 1983.
3. You may only make partial repayment of capital by monthly repayments.
Irrespective of any arrangement entered into by the lender to defer any payment date the Lenders will reserve the right to charge interest based on the dates set down in this agreement. If you break any term of a Loan Agreement and then fail to comply with the notice that the lenders are required by law to send you, you will have to repay to the lender immediately the necessary amount as calculated using the method described above in this agreement.
The lender may debit your account with the costs incurred in respect of breaches of any agreement you may enter into including Bank charges on returned cheques or standing orders, court fees, tracing fees and the cost of writing letters, telephoning you and visiting you at home. Any monies received from you will be appropriate firstly to the costs mentioned immediately above, secondly to interest, and thirdly to capital repayment.
15. You will solely be liable for any direct and indirect losses You suffer in the event of a failure of us being unable to obtain a satisfactory loan offer for You. We shall not in any circumstances be liable for any breach of obligation or decision not to lend to You by any lender, financier, bank, counterparty, intermediary or other third party with whom You do business. If You provided Us with inaccurate information We will incur no liability for any loss arising from non performance by Us. We accept no responsibility for any additional credit searches you may incur as a result of Us passing your application to lenders or any of the effects these additional searches may have on Your credit score.
Each of these terms is to be deemed modified sufficiently to render it enforceable, legal and valid and of similar effect as We intended in the event that any of these provisions (each of which is severable) is for any reason illegal, invalid or unenforceable. Nothing in these terms is enforceable by anyone who is not a party to them except as stated for provisions expressly covering associate companies.
17. PiExpert shall be liable only to provide its services with reasonable skill and care and gives no other warranty in connection to the services.
18. Subject to the maximum extent permitted by law PiExpert excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect, punitive or consequential loss whether or not such arises out of any problem you notify to PiExpert and PiExpert shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to: any incorrect or inaccurate information and all interruptions to or delays in the service; the infringement by any person of any Intellectual Property Rights of any third party; any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Website, or from transmissions via emails or attachments received from PiExpert or its licensees; and all representations, warranties, conditions and other terms which but for this notice would have effect.
19. These terms above shall not limit any rights you might have as a consumer that may not be excluded under applicable law nor shall it exclude or limit PiExpert’s liability for death or personal injury resulting from neither its negligence nor any fraudulent representation.
20. PiExpert have used all reasonable efforts to ensure that all information provided by it is accurate and accords with current standards however it cannot account for the accuracy of information posted by users of the Website.
21. It is agreed, acknowledged and understood that the services contained within are provided for information only and are not intended to replace appropriate financial advice where required, financial advice and the financial markets are constantly evolving, and PiExpert cannot guarantee that all of the information is completely accurate.
22. This service is to be used solely for private, non-commercial, personal purposes only. Accordingly, You undertake not to use the service for any commercial or business purpose.
23. Except as provided above and subject to Your statutory and common law consumer rights there are no other warranties, conditions or other terms, express or implied, statutory or otherwise, and all such terms are hereby excluded to the maximum extent permitted by law.

25. PiExpert acts as principal on its own account and not as agent for You or any other person.
26. If PiExpert does not enforce any provision of this agreement this will not be considered a waiver of any provision or right.
27. These terms and conditions constitute the entire agreement between You and PiExpert and shall apply to the exclusion of all other terms or conditions of contract which You may purport to propose.
28. We may contact You about services or products offered by Us or other companies We approve which We believe You may be interested in or to carry out market research about our services or products or those of other companies. We may also pass on information so that other companies approved by Us may contact You about services or products which they believe You may be interested in. Contact for these purposes may be by post, email, SMS or by other means. This will override any registrations You may have with any preference services. You agree that We may analyse information about You and your conduct including your payment record to determine which services or products You might be interested in.
29. PiExpert shall be entitled to terminate this Agreement immediately upon your breach of any part of these Terms whatsoever. Termination shall be without prejudice to the accrued rights of either party. PiExpert will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communications outages, fire, flood, war or act of God.
